These terms apply to your use of www.aetherdevelopers.com (the “site”), run by Aether Developers (“Aether”, “we”, “us”) of Austin, Texas. By using the site, you accept them. If you do not accept them, please do not use the site.

How we handle personal information is described in our Privacy Policy.

The site describes our business and the kinds of opportunities we pursue. Nothing on it is an offer to sell, or a solicitation of an offer to buy, any security or any interest in a fund, project or company.

An investment offering is made only through its confidential Private Placement Memorandum and the related subscription documents, only to investors who qualify under the securities laws that apply, and only where the offering is lawful. If anything on the site differs from those documents, the documents govern.

Descriptions of specific opportunities, such as their size, target returns, amount sought or status, are summaries for general information. They can change, fill or be withdrawn at any time without notice.

Expected returns, target returns, timelines and other statements about the future on the site are estimates. They rest on assumptions that may prove wrong, and they are not promises or guarantees. Actual results may differ materially.

Real estate investments are speculative and illiquid. You may be unable to sell your interest, and you can lose some or all of the money you invest. Past results do not predict future results.

Statistics about markets on the site come from public sources and may be out of date.

Nothing on the site is investment, legal, tax or accounting advice, or a recommendation that any investment suits you. Before you invest, read the offering documents and talk to your own advisers.

Unless a caption says otherwise, the photographs and video on the site are representative. They illustrate the kinds of buildings and places we work with. They do not show a property that Aether owns or has built, or a specific opportunity.

Sending an inquiry, or details of land or a property you want to sell, does not create an obligation for you or for us. It does not create a partnership, an advisory relationship or a contract. We may decline any inquiry.

Any investment, purchase or sale of property, assignment of a purchase contract, joint venture or other deal happens only under a signed written agreement. That agreement governs the deal, and these terms do not change it.

Please do not send us information that you are not free to share.

You agree not to:

• use the site for anything unlawful, fraudulent or misleading;
• give false information, or pretend to be someone else, in an inquiry;
• send spam or bulk messages through the contact form;
• use bots, scripts or scrapers on the site, or try to get around its bot check;
• try to interfere with, overload or gain unauthorized access to the site or the systems behind it.

The site’s text, design, logos, the name “Aether Developers” and the name “Aether Panelized Systems™” belong to Aether or to those who license them to us. Some photographs are used under license from third parties. You may view the site and share links to it. Do not copy, republish or use its content commercially without our written permission.

The site links to services we do not control, such as Google Maps, Facebook and LinkedIn. Their own terms and policies apply there, and we are not responsible for their content.

We work to keep the site accurate, but we provide it “as is” and “as available”. To the extent the law allows, we make no warranties about it, express or implied, including that it is complete, current, error-free or always available.

To the extent the law allows, Aether is not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or data, that arise from your use of the site or your reliance on its content. Our total liability for any claim about the site is limited to US$100.

These limits apply to the website only. A signed agreement with us sets the terms of that relationship.

If your breach of these terms, or your misuse of the site, leads to a claim against Aether, you agree to cover the reasonable losses and costs that result, to the extent the law allows.

These terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Disputes about them or the site go to the state and federal courts in Travis County, Texas, and you and we agree to their jurisdiction.

We may update these terms. When we do, the effective date at the top moves. The version on the site when you use it is the one that applies.
